This Privacy Policy (this “Policy”) sets out how we collect and process personal information about you when you visit our website at https://www.apeironnft.com, when you use our mobile dapp, when you play our game (our “Game”), or when you otherwise do business or make contact with us. 1. WHAT DOES FOONIE DO WITH USER’S INFORMATION? Information you Provide Foonie Magus and our Service Providers (defined below) may collect information you provide directly via the Service. For example, we collect information when you sign up to receive periodic updates and promotional materials from us; make a purchase through the Service; or receive customer or technical support. The information we collect may include personal information. “Personal information” means information that can be used to identify you personally (whether alone or in combination), such as your first and last name, e-mail address, phone number, and postal address. You may choose to voluntarily submit certain other information to us through the Service, including personal information, but you are solely responsible for your own personal information in instances where we have not requested that you submit such information to us. We may make your personal information non-personally identifiable by either combining it with information about other users (aggregating your personal information with information about other users), or by removing characteristics (such as your name or e-mail address) that make the information personally identifiable. Foonie Magus collects data to enable us to operate the Game effectively, and to provide you with the best experiences on our website and our Game. You provide some of this data to us directly, such as when you register to use our Game, subscribe to a newsletter, respond to a survey, make an enquiry through our website, contact us for support, or contact us as a prospective user, vendor, supplier, or consultant. We get some of your data by recording how you interact with our website and our Game by, for example, using technologies like cookies. We also obtain and process data in the context of making the Game available to you. You have choices about the data we collect. When you are asked to provide personal data, you may decline. But if you choose not to provide data that is necessary to enable us to make the Game available to you, you may not be able to sign up for or play the Game. The data we collect depends on the context of your interactions with Foonie Magus, and the choices you make (including your privacy settings). The data we collect can include the following: Email and Metamask Wallet Address. We may collect your email address and your Metamask wallet address. Device and Usage information. We may collect data about your device and how you and your device interact with Foonie Magus and our Game. For example, we may collect your interactions on our website, your feature usage patterns, location data, and your interactions with us. We may also collect data about your device and the network you use to connect to our Game; this may include data such as your IP address, browser type, operating system, and referring URLs. 2. - HOW FOONIE MAGUS USES USER’S INFORMATION We use the data we collect to operate our business, and to make the Game available to you. This includes using the data to improve our Game, and to personalize your experiences. We may also use the data to communicate with you to, among other things, inform you about your account, provide security updates, and give you information about the Game. We may also use the data to manage your email subscriptions, improve the relevance and security of our website, respond to user enquiries, send you periodic marketing communications about our Game, and improve the relevance of our advertising. Providing and improving our Game. We use data to provide the Game to you, to improve the Game, and to perform essential business operations. This includes operating the Game, maintaining and improving the performance of the Game, developing new features, conducting research, and providing customer support. In certain cases, the Game may include personalized features and recommendations to enhance your enjoyment, and automatically tailor your experience based on the data we have about you. We use data to continually improve our website and our Game, including system administration, system security, and adding new features or capabilities. Business Operations. Additionally, you can sign up for email subscriptions, and choose whether you want to receive marketing communications from us. 3. - SECURITY Foonie is very concerned with safeguarding user’s information. Foonie employs reasonable measures designed to protect user’s information from unauthorized access or against loss, misuse or alteration by third parties. We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information. We offer the use of a secure server. All supplied sensitive information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential. Although Foonie makes good faith efforts to store the information collected on the Services in a secure operating environment that is not available to the public, Foonie cannot guarantee the absolute security of that information during its transmission or its storage on Foonie’s systems. Further, while Foonie attempts to ensure the integrity and security of network and systems, Foonie cannot guarantee that Foonie’s security measures will prevent third-party “hackers“ from illegally obtaining access to this information. Foonie does not warrant or represent that user’s information will be protected against, loss, misuse, or alteration by third parties. User acknowledges that no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, Foonie cannot guarantee absolute security of user’s information. 4. - TRACKING COOKIE DATA We use cookies and similar tracking technologies to track the activity on our Service and hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. These third parties have access to user’s information only for purposes of performing these tasks on Foonie’s behalf. We may use and share aggregated non-personal information with third parties for marketing, advertising, and analytics purposes. We do not sell or trade your personal information to third parties. We may share information about you, including personal information, under the following circumstances: Service Providers. We may share your information with our agents, vendors, consultants, and other service providers (“Service Providers”) that we engage for the purpose of processing information on our and your behalf to deliver, develop, improve, and protect our products and the Service, and communicate with you in response to your questions and regarding the Service. For example, we may engage other companies to process payments for the Service. Additionally, we may engage other companies to process, analyze, and/or store data and assist with our marketing efforts (for information about how to exercise choice regarding sharing of information with Service Providers, see “Your Choices” and “Your European Privacy Rights” below). While providing services for us, these companies may access your personal information. Sweepstakes, Contests, Promotions We may offer sweepstakes, contests, surveys, and other promotions (each, a “Promotion”) jointly sponsored or offered by third parties that may require submitting personal information. If you voluntarily choose to enter a Promotion, your personal information may be disclosed to third parties for administrative purposes and as required by law (e.g., on a winners list). By entering, you agree to the official rules that govern that Promotion, and may, except where prohibited by applicable law, allow the sponsor and/or other parties to use your name, voice and/or likeness in advertising or marketing materials. THIRD PARTIES (1) Links This Privacy Policy does not cover the information practices of websites, locations, platforms, and services operated and owned by third parties (“Third Party Services”) linked to the Service. When you have clicked on a third party logo or URL displayed on our Service which links you to a different website, our Privacy Policy no longer applies and you must read the privacy policy of the Third Party Service to see how your personal information will be handled on their website. For example, we may include links to Steam, Apple’s App Store, the PlayStation Store, and the Xbox Store. Also our online store is operated by a third party and when you checkout you are on a different website not owned or operated by us. We are not responsible for these or any other third parties’ collection and use of your personal information. (2) Third Party Features Our Service contains features that allow you interact with, connect to, or access our Service through certain Third Party Services (“Third Party Features”). For example, you may interact with a Third Party Service when you shop on our online store and “like” or “share” content over social media through our Service. Because different countries may have different data protection laws than your own country, we take steps to ensure adequate safeguards are in place to protect your data as explained in this Privacy Policy. Adequate safeguards that we may use include standard contractual clauses approved by EU Commission and other lawful safeguards. YOUR RIGHTS AND OPTIONS Opt out of marketing emails and other direct marketing - You may opt out of receiving promotional communications, such as marketing emails from us by following the instructions in such communications, or by changing your in-game settings. The updated settings may not be effective immediately. Note that you may still continue to receive non-promotional communications from us, such as communications regarding the Service or updates to our Foonie Magus Terms of Service or this Privacy Policy. Push Notifications - We may send you push notifications through our mobile applications. You may at any time opt-out from receiving these types of communications by changing the settings on your mobile device. Opt-out of targeted advertising - You can opt-out of interest-based advertising on mobile applications by checking the privacy settings of your Android or iOS device and turning off “Allow Apps to Request to Track” or selecting “Limit Ad Tracking“ (Apple iOS) or “Opt-out of Interest Based Ads“ (Android). You can also opt out from personalized in-game offers through the options provided in the game settings (where applicable). Access the personal data we hold about you - If you request, we will provide you a copy of your personal data in an electronic format. For Tracking Technology, regular cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Browsers offer different functionalities and options so you may need to set them separately. With respect to our Apps, you can stop all collection of information via the app by uninstalling the App. Also, you may be able to exercise specific privacy choices, such as enabling or disabling certain location-based services, by adjusting the permissions in your mobile device. Please be aware that if you disable or remove these technologies some parts of the Service may not work and that when you revisit the Service your ability to limit browser-based Tracking Technologies is subject to your browser settings and limitations. Your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit. Note, however, there is no industry consensus as to what site and app operators should do with regard to these signals. Company is not responsible for effectiveness of, or compliance with, any third-parties’ opt out options or programs or the accuracy of their statements regarding their programs. Your other rights - You also have the right to correct your data, have your data deleted, object how we use or share your data, and restrict how we use or share your data. You can always withdraw your consent. We will respond to all requests within a reasonable timeframe. If you wish to exercise any of your data subject rights described above, you may request that Foonie Magus delete your personal data by submitting an email to us at dpo@fooniemagus.com.co and including “Please delete my personal data” in the “Subject” line. Foonie Magus will verify your ability to access that email, then delete the personal data associated with your email address. We will use reasonable efforts to respond to your request within 14 days, but in all events within 30 days of our receipt of the request. We will respond to all requests in accordance with applicable laws. To protect your privacy, we may also take additional steps to verify your identity before fulfilling your request, such as by requesting you provide us a purchase receipt or other account information, asking you to link your email address with your game account, or asking you to answer questions regarding your activities on our Services. Once you have verified your identity, you may also designate an authorized agent to exercise your rights on your behalf by providing the agent’s contact information to our customer support staff, as required by applicable law. You have the right not to receive discriminatory treatment as a result of your exercise of these rights. Your California Privacy Rights California’s “Shine the Light” law permits customers in California to request certain details about how certain types of their information are shared with third parties and, in some cases, affiliates, for those third parties’ and affiliates’ own direct marketing purposes.
